In short

  • Yes. If you ran the business together and obtained them legally at the time, they can be used.
  • Whether they count as private is a separate question from whether they can be used as evidence. Your former lawyer was wrong.
  • Banks keep records only seven years. After that, even a court order can't retrieve anything older. What you saved is the only copy.
  • Don't wait for the other side to disclose. If they won't, what you hold is Plan B. Organize it by year and show it to your lawyer first thing.

Yes. If you ran the business together and obtained them legally at the time, they can be used. Whether they count as private is a separate question — lawful sourcing is what matters. Your former lawyer was wrong. And act now: banks keep records only seven years — even a court order can’t retrieve anything older.

1. Yes: A Joint Business, Legally Obtained

You’re spouses who ran a company together. The statements and tax records you handled while keeping the books were obtained legally at the time.

The other side will say “this is private, you can’t use it” — but those are two different questions. Whether something is private and whether it can be used as evidence are separate issues. What matters is that you obtained them lawfully: voluntarily provided, nothing stolen, nothing taken by force.

2. Why You Must Move Now: Banks Keep Records Only Seven Years

Banks retain records for seven years. If you separated years ago and are only suing now, even a court order can’t retrieve the earlier statements — they no longer exist in the bank’s system.

The years you saved yourself are the only, irreplaceable copy.

The longer you wait, the less can be retrieved. Evidence has an expiry date.

3. What These Records Prove

The real money flow: the other side’s tax return says no income, but the statements show large annual flows — do they add up?

Where the money went: transfers to personal accounts labeled “supplier payments” that were actually personal spending, visible in the statements.

Whether deductions were real: pull the receipts behind the tax deductions and check them line by line — fake deductions can’t hide.

What to Do

Organize the statements, tax records, and deduction receipts by year, filed and safe.

Don’t wait for the other side: if they won’t disclose, what you hold is Plan B.

Request bank records early: after seven years, not even a court can retrieve them.

Show this batch to your lawyer first thing: it’s the foundation of the case.

FAQs

1. I kept the books — does using these records breach confidentiality?

No. You’re the spouse, not an outside hire; the materials were legitimately obtained in the joint business. Confidentiality guards against outsiders, not against a spouse using them in her own divorce.

2. The other side says it’s company-confidential and I can’t use it. What then?

Lawfully sourced beats that objection. In court, the burden is on them to show why not — and “lawfully obtained by a spouse in the joint business” is not something they can get around.

3. Are bank records over seven years truly gone?

Truly. They no longer exist in the bank’s system, and no court order can conjure them. What you saved yourself is the only copy.
