Miao He (何淼) is a dual-licensed family lawyer in Ontario and China. Called to the China Bar in 2009, she has practised as a litigation lawyer ever since, with 15+ years of experience serving Chinese-Canadian families across the GTA. Her practice has concentrated on family law litigation, with substantial courtroom experience in high-conflict divorce, parenting, and property disputes. ABOUT

I am Miao He (何淼), a dual-licensed family lawyer holding both an Ontario bar licence and a China bar licence. I was called to the China Bar in 2009 and have practised as a litigation lawyer ever since — first in China, and later in Canada after completing my Master of Laws (LL.M.) at Osgoode Hall Law School. My practice has concentrated on family law litigation, with substantial courtroom experience in high-conflict divorce, parenting, and property disputes. I also hold a Certified Mediator designation in Ontario and have been formally retained by other law firms as an Expert Witness on PRC family law and matrimonial property matters in Ontario court proceedings.

I have practiced family law in the Greater Toronto Area for over 15 years and serve as the principal lawyer at H. LAW FIRM, located in Markham. From Chinese commercial and matrimonial litigation to Ontario family court advocacy, I have built a courtroom-first practice across both jurisdictions.

I appear in court over 20 hours per month and provide more than 200 legal consultations per year — making me one of the most active family lawyers serving the Chinese-Canadian community in the GTA.

My philosophy is simple: negotiate when it makes sense, litigate when it is necessary. I hold a Mediation Certificate and can represent clients effectively in both court and non-court proceedings.

Certified Mediator

Miao He is a Certified Mediator in Ontario and has practical experience in mediation and negotiation within the context of family law disputes.

Mediation certification and a lawyer's licence are two distinct professional qualifications. A family lawyer with mediation training is able to apply a structured, settlement-oriented approach to dispute resolution, identify the parties' underlying interests more effectively, and assess potential resolution pathways at an early stage of the process.

Where settlement cannot be achieved through negotiation or mediation, the lawyer is able to seamlessly transition into litigation strategy and advocacy. This dual capability supports a comprehensive and strategic approach to high-conflict family law matters, where both resolution-focused negotiation and litigation readiness are essential.

Expert Witness (PRC Family Law)

Miao He has been formally retained by other law firms to provide expert witness opinions on the law of the People's Republic of China relating to marriage, family, and matrimonial property matters (PRC family law and matrimonial property regime). These expert opinions have been prepared and submitted for use in proceedings before the Ontario courts.

An expert witness is distinct from a legal advisor. The role requires specialised and systematic knowledge of a foreign legal system and is limited to providing independent, objective, and admissible legal analysis to assist the court in determining issues of foreign law.

In family law disputes involving Chinese law issues, such as classification of matrimonial property, identification of pre-marital assets, and evidentiary requirements under PRC law, expert evidence is often a key component of the court's analysis.

In Ontario family law proceedings, matters involving PRC family law and matrimonial property regimes require a high level of specialised expertise. Lawyers with experience providing expert witness opinions in this context are able to offer structured and court-ready legal analysis in cross-border family law disputes.

THE DUAL-LICENCE ADVANTAGE

Holding both Ontario and China bar licences, I can directly investigate and handle assets held in China — real estate, company shares, and family trusts. Represented the respondent against eight simultaneous claims including a CBV business valuation dispute. All eight claims defeated at motion. Costs awarded for lack of candour. Appeal unanimously dismissed by three Divisional Court judges.
