Each spouse calculates their Net Family Property (NFP) using this formula: (Value of all property at date of separation) minus (Debts and liabilities at date of separation) minus (Value of property owned at date of marriage, with exceptions). The result is each spouse NFP.

The spouse with the higher NFP pays the other spouse half the difference between their NFPs. This payment is called the equalization payment. It is a dollar amount — not a transfer of specific assets. The parties can agree on how to fund it.

Important exceptions: certain property is excluded from NFP, including gifts and inheritances received during the marriage (if properly traced), damages for personal injury, and life insurance proceeds. However, these exclusions require careful documentation and tracing.

The matrimonial home is subject to a special rule: unlike other assets, the value the home had at the date of marriage cannot be deducted from NFP, even if one spouse owned it before the marriage.
