First: the nature of the property. Ontario law treats matrimonial homes differently from investment properties. A matrimonial home is valued at its full market value on the date of separation — no deductions are permitted for pre-marital contributions or parental funds used toward the purchase. This means that if the parental contribution went into a matrimonial home, it cannot simply be deducted from the equalization calculation. Investment properties are treated differently — pre-marital value can potentially be deducted as a date-of-marriage asset.
Second: whose account the money was deposited into. If the funds were transferred only into one spouse's personal account, it is easier to argue that the contribution was made to that individual — whether as a gift or a loan. If the money went into a joint account or directly to the other spouse, establishing ownership becomes more difficult, and the other side may argue the contribution was made to both spouses equally.
